Rules for transporting children on the bus.

The rules for organized transportation of groups of children were developed by the Ministry of Transport of Russia and adopted by Decree of the Government of the Russian Federation No. 1177 of December 17, 2013. The revision of the document, with amendments, was made by Decree of the Government of the Russian Federation No. 652 dated June 30, 2016. Some of the changes came into effect on July 10, 2016, while others were delayed until January 1, 2017. The new rules for transporting children by bus 2016 state: the requirements for the bus, the driver and the person who is the accompanying person; list of documents required for transportation; additional conditions and nuances of transportation.

What changes have appeared?

The latest version of the document made the following changes: A new concept of "organized transportation of children" was introduced.

Previously, under this term it was accepted: any transportation of 8 or more children; transportation is carried out by non-route vehicles. Currently, a clarification has been made that transportation is carried out without representatives of children, which include parents, adoptive parents, guardians or trustees. The exception is situations when the official representative is: an escort of the group or a medical worker whose presence is required during the transportation.

Based on this change, it turns out that if children are transported accompanied by parents who are not accompanying groups, for example, a group of tourists consisting of children and parents, then it is carried out on the basis of general rules that do not apply to transportation organized groups children established by Decree No. 1177. In this situation, parents or legal representatives must independently ensure the safety of the child on the basis of the transportation agreement and the rules for transporting children on the bus SDA 2016.

The new regulatory document included the obligatory fulfillment of the following conditions:

  • children must be more than 8;
  • the bus should not stand on the route and be currently public transport;
  • escort of buses with children is currently provided only in the presence of a column consisting of 3 or more Vehicle;
  • for the transportation of children, a permit is required, the document is issued by an authorized employee of the district traffic inspectorate. Until 2016, the original permit had to be kept by the driver and presented at the first request of an employee of the State traffic inspectorate. After making changes, it is enough for the driver to have a copy of this document. The originals must be kept in the company for at least 3 years after the carriage;
  • transportation of children between 11 p.m. and 6 a.m. is allowed only in exceptional cases, which include: moving to railway or air stations to reduce the waiting time for a train (airplane) to depart; unplanned delays while driving, for example due to bad road or weather conditions. Movement after 23 hours should be carried out at a distance of no more than 50 km. Otherwise, the group leader must decide on an unscheduled stop in order to give the children time to rest.

So, with the organized transportation of small passengers, special attention must be paid to: the need for the crew to accompany the traffic police; completeness of documentation; requirements for the driver and buses; requirements for persons accompanying children; rules for boarding a vehicle.

Accompanying a group of traffic police children

Initially, you need to decide on the transport company or other person who will carry out the transportation. Further, a charter agreement is concluded between the person responsible for the group of children and the contractor directly. Based on this agreement and the communication of route data, an appropriate notification is made about the transportation of children by bus to the traffic police traffic police. In order to receive escort by the traffic police for a column of buses consisting of 3 or more buses, it is required to submit a written application for escort no later than two days before the start of transportation.

An application for escort by a car of the State traffic inspectorate must contain the following data:

  • the time period in which support is required;
  • the route of the column;
  • the number of buses involved, their brands and models with license plates, as well as the driving license data of their drivers;
  • name of the customer;
  • name of the transport company or carrier;
  • Name of the accompanying group;
  • amount of children.

The application is submitted by a representative of the organization - the carrier to the regional department of the State traffic inspectorate. The response from the traffic police is also drawn up and transmitted to the applicant in writing.

If children are transported by one or two buses, then at the traffic police department (also a maximum of 2 days before the trip) a notification is submitted about the transportation of children.

The document must contain:

  • information about the company that is the organizer of the transportation;
  • information about the carrier company;
  • date of transport;
  • the route of the bus, supplemented by the names of the starting and ending points;
  • the number of children transported, indicating the age category;
  • brand and license plate of the bus delivering children;
  • data of the person accompanying the group.

The notice must be marked that the State traffic inspectorate knows and allows the transportation of children along the specified route and at the specified time. A copy of the application for escort or notification of transportation is a mandatory document that must be kept by the driver. As a result, the person responsible for the transportation of children must receive one of the following documents: a copy of the notification about the transportation of children by bus, or a copy of the approved escort of the convoy by traffic police cars.

During the movement of the column in the salons of buses there should be no one, except for those persons who are included in the compiled lists. If it is planned that during the movement someone will be planted, then he must be included in the list in advance.

Required documentation for transporting children

To transport children, you need to prepare a large package of accompanying documents, which should include the following:

  • a charter or transportation agreement concluded between the organizer and the executor of the transportation;
  • a document containing information about a medical worker who is obliged to accompany a group of children when a column or bus moves for more than 12 hours;
  • a copy of the transport permit;
  • copies of the notice of carriage or application for escort;
  • list of persons who are accompanying the group. In the list, it is required to indicate not only the full name of people, but also passport data, and Contact phone numbers for emergency communication; list of children (name and age);
  • list food products that children may have during transport. Most often, the list includes dry rations and bottled water;
  • a document reflecting information about bus drivers involved in the transportation of children. The document should reflect: full name of drivers, details of driver's licenses, contact numbers;
  • a document reflecting the procedure for boarding children on the bus, indicating a separate seat for each person. The document can be drawn up by: the organizer of the trip; accompanying person; health worker, taking into account the individual characteristics of each child; representative of the carrier company, if this condition is an integral part of the concluded contract of carriage;
  • a document containing the itinerary of the trip, which includes: the schedule of the bus with the definition of the time period of movement, places of stops for rest, meals, excursions, indicating the name of the organization providing the corresponding action. For example, the name of the hotel where the children should stay for recreation or the names of the organizations that conducted the excursions, the dates and estimated times of stops for the needs of passengers;
  • When a column of buses moves, each vehicle is assigned a serial number, which it must adhere to when moving.
  • All documents must be handed over to the driver one day before the transportation of children.

It is worth noting that until 2016 the driver had to have continuous experience for 12 months. If at least one day fell out, then he was automatically not allowed to govern.

Buses must meet the following requirements:

With regard to the admission of vehicles to organized transportation of children, the new requirements should come into force on January 1, 2017.

These include:

  • the presence of a diagnostic card or a technical inspection coupon confirming the good condition of the bus;
  • the age of the bus should not exceed 10 years from the date of manufacture of the vehicle;
  • all buses must be equipped with tachographs - special devices for monitoring the speed of the vehicle, compliance with the regime of work and rest of drivers;
  • all buses must be equipped with Glonass satellite navigation systems, which allow determining the location of the vehicle at any time.

REQUIREMENTS FOR ACCOMPANYING ADULTS

When transporting children, accompanying persons must be appointed, whose main duties are:

  • coordinating the movement of the bus in case of unforeseen circumstances, for example, in case of worsening weather conditions;
  • monitoring the behavior, health and nutrition of children during transportation.

The number of accompanying persons in one bus is determined by the number of doors each vehicle has. That is, an adult responsible for children during transportation should be at each door to avoid accidents during movement. If there are several accompanying persons on the bus, then a responsible person is appointed among them, coordinating the work of all adults.

ADMISSION TO THE BUS

The group for transportation may include children of different age categories. The only restriction applies to children under the age of 7 years. Such persons may be transported in groups only if the travel time is less than 4 hours. In other cases, transportation of young children in groups is prohibited. Children on the list provided by the group leader are allowed on the bus for transportation. Other persons are not allowed on the buses. However, at its discretion, the list of children can be changed unilaterally before the vehicle starts moving, that is, the team leader or other person responsible for compiling the document can change the list without prior notice to the carrier.

Liability for incorrect transportation

Each organized transportation of children must be carried out in accordance with accepted and established rules. For each non-fulfilled requirement, a fine is provided in accordance with Art. 12.23 of the Code of Administrative Offenses.

Based on the Code of Offenses, there is a penalty for improper transportation of children in any of the following cases:

  • transportation of children does not meet the requirements;
  • the driver does not meet the requirements;
  • there is no charter agreement;
  • inconsistent route;
  • there is no list of children and responsible;
  • for drivers 3 thousand rubles, for due. persons 25 thousand rubles, for legal entities. persons - 100 thousand rubles.

There is also a fine for transporting children at night:

for drivers 5 thousand rubles or deprivation of a VU for 4-6 months, for due. persons 50 thousand rubles, for legal entities - 200 thousand rubles.

Transportation of children must be carried out in strict compliance with the rules approved by Government Decree No. 1177. To ensure maximum safety for small passengers, the rules are constantly being changed and supplemented based on other regulations and the environment.

Spring is in full swing and the traditional time has come a large number trips of organized groups of children - on excursions, to camps, to country walks. With the end of the school year, many schoolchildren go on various trips, and graduates of elementary school and even those who have completed the first grade are organized festive outdoor events. Previously, the coach bought tickets en masse and carried everyone. Now she does not have a doctor, and she does not have the right to carry a group. Today, the main sadness and problem of parents, as they believe, is that due to new requirements, children are deprived of trips out of town, excursions and participation in contests and competitions.

But is the new Rules for transporting children so unbearable? And what exactly are they related to?

The main points of the Rules of carriage

From January 1, 2014, the Government Decrees came into force Russian Federation dated December 17, 2013 No. 1176 “On amendments to the Rules traffic Russian Federation” and No. 1177 “On Approval of the Rules for the Organized Transportation of a Group of Children by Buses”.


The changes made to the Rules of the Road specify the concept of "organized transportation of a group of children" - now organized transportation of eight or more children in buses falls under this definition, not related to route vehicles(highlighted ed.). The bus used for the organized transportation of a group of children must be marked with identification signs "Transportation of children", and the transportation itself must be carried out in accordance with the Rules for the organized transportation of a group of children by buses, which are approved by a separate decree of the Government of the Russian Federation.

We will not fully publish the text of the Rules here, it can be found on the Official Internet Portal of Legal Information, and we will consider only those points that relate specifically to the transportation of children, and not the timing and methods of processing documents.

So, the points of the Rules that Nizhny Novgorod parents need to know if they want their children to participate in trips in groups on specially (!) Hired buses:

Clause 3. For the organized transportation of a group of children, a bus is used, from the year of manufacture of which no more than 10 years have passed, which meets the technical requirements for passenger transportation in terms of purpose and design, is allowed to participate in road traffic in the prescribed manner and is equipped in the prescribed manner with a tachograph, as well as GLONASS or GLONASS/GPS satellite navigation equipment.

This item excludes the possibility of using old minibuses as a carrier. So the parents were right.

Clause 4. For organized transportation of a group of children, the following documents are required:

A) a charter agreement concluded in writing;

B) a document containing information about the medical worker (last name, first name, patronymic, position), a copy of the license to carry out medical activities or a copy of the contract with a medical organization or an individual entrepreneur that has the appropriate license - in the case provided for in paragraph 12 of these Rules;

D) a list of a set of food products (dry rations, bottled water), - in the case provided for in paragraph 17 of these Rules;

E) a list of designated accompanying persons (indicating the last name, first name, patronymic of each accompanying person, his telephone number), a list of children (indicating the last name, first name, patronymic and age of each child);

E) a document containing information about the driver (drivers) (indicating the last name, first name, patronymic of the driver, his phone number);

H) a traffic schedule, including the estimated time of transportation, indicating the places and times of stops for rest and food (hereinafter referred to as the traffic schedule), and a route scheme.

Clause 9. Inclusion of children under the age of 7 years in the group of children for organized transportation by buses while they are on the way according to the traffic schedule for more than 4 hours is not allowed.

Clause 11. At night (from 11 p.m. to 6 a.m.), organized transportation of a group of children to railway stations, airports and from them, as well as the completion of the organized transportation of a group of children (delivery to the final destination determined by the traffic schedule, or to the place of lodging for the night) in case of an unplanned deviation from the traffic schedule (during a delay on the way). In this case, after 23 hours, the distance of transportation should not exceed 50 kilometers.

Clause 12 more than 3 hours according to the traffic schedule, the head or official responsible for ensuring road safety, organization, and in the case of organized transportation of a group of children under a charter agreement - the charterer or charterer (by mutual agreement) provides escort for such a group of children medical worker.

That is, a medical worker is needed in a group of children if they travel outside Nizhny Novgorod region, and in our region, almost all distances can be covered within 3 hours.

Clause 14. The head or official responsible for ensuring road safety of the organization, and in the case of organized transportation of a group of children under a chartering agreement, the charterer shall ensure the appointment to each bus transporting children, accompanying, who accompany children during transportation to the destination.

The number of accompanying persons per 1 bus is assigned based on their presence at each door of the bus, while one of the accompanying persons is responsible for the organized transportation of a group of children on the corresponding bus and coordinates the actions of the driver (drivers) and other accompanying persons in the specified bus.

There is nothing new here, because. children have never gone anywhere without accompanying persons.

Paragraph 17. If children are on the way according to the traffic schedule for more than 3 hours, the head or official ... ensures the availability of food kits (dry rations, bottled water).

Traveling by regular bus without rules

First, let's summarize what was written above.

So, as before, to take the children somewhere exclusively on a specially hired (chartered) bus, you need to sign an agreement with the carrier company. There is nothing unusual about this requirement. If children go, say, on an excursion to Semyonov to see how nesting dolls are painted under Khokhloma, they do not need a doctor to accompany them, and they also do not need food, therefore, there is no need to draw up the appropriate papers. If the children are being taken, say, to Suzdal, which will take much more than 3 hours, and it will also be necessary to return, then it seems logical for a doctor to go with the children - the children are restless and, you never know, the parents themselves will be calmer, if there is a paramedic on the bus with them.

What about travel anywhere? on scheduled buses, then these Rules have nothing to do with route vehicles. That is, if parents want to take even 8 or more children either to some district of Nizhny Novgorod, or to the same Semenov, or even to Suzdal by regular bus, these Rules are not decreed for them.

Returning to the first chapter of our material, we note that a participant in our forum, who wrote how children "occupy" the bus at the final stop, is absolutely right - this is a very real trip of children across Nizhny Novgorod regardless of the rules. But the coach of the dance group, who used to buy bus tickets and take the children together to the competition, can continue to do this even without having a doctor on hand, because, it is clear that she did not charter a special vehicle, therefore, And she doesn't need a doctor.

If transportation is carried out by several buses, a senior responsible for the organized transportation of a group of children is appointed.

    Transportation of children on buses is carried out during daylight hours. It is forbidden to transport children's groups at night without special permission.

    For the organized transportation of a group of children, a bus is used, from the year of manufacture of which no more than 10 years have passed, which meets the technical requirements for passenger transportation in terms of purpose and design, is allowed to participate in road traffic in the prescribed manner and is equipped in the prescribed manner with a tachograph, as well as equipment satellite navigation GLONASS or GLONASS/GPS.

    This paragraph of the rules comes into force on 06/22/2015.

    At night (from 11 p.m. to 6 a.m.), organized transportation of a group of children to and from railway stations, airports and from them is allowed, as well as the completion of an organized transportation of a group of children (delivery to the final destination determined by the traffic schedule, or to the place of accommodation) in case of unscheduled deviation from the traffic schedule (during a delay on the way). In this case, after 23 hours, the transportation distance should not exceed 50 km. The number of passengers must not exceed the number of seats on the bus.

    The bus must have a package of documents necessary for the transportation of passengers:

    A) charter agreement concluded by the charterer and the charterer in writing, ? in the case of organized transportation of a group of children under a charter agreement;
    b) a document containing information about a medical worker(last name, first name, patronymic, position), a copy of the license to carry out medical activities or a copy of the contract with a medical organization or an individual entrepreneur that has the appropriate license, ? in the case provided for in paragraph 12 of these Rules;

    The bus must be equipped with seat belts on each passenger seat, two fire extinguishers, 3 first aid kits with valid term validity, signs "children", anti-recoil stops.

    Embarkation and disembarkation of a children's group from the bus must be carried out in specially designated places (at bus stops).

    When transporting a group of children on a bus, it is prohibited:

  • eat food;
  • move around the cabin of the bus while driving;
  • smoking, drinking alcohol (including beer and cocktails);
  • create situations that interfere with the comfort of other passengers or the safety of the bus;
  • leave behind dirt, debris;
  • spoil the internal inventory of the bus, and in the event of a breakdown of any thing or mechanism, inform the driver about it. The driver fixes the damage in the waybill.

    In some cases, by-laws regulations an additional regulation for checking buses transporting children has been established. In the Subject of the Russian Federation of the Moscow Region, when carrying out an excursion from a school in all cities of the Moscow Region, vehicles carrying children are checked. To submit an application to the traffic police for inspection of transport before the start of the tour, information is required on the dates, number and time of the tour. Then the director of the educational institution issues an Order on the excursion. Upon successful acceptance of the application to the traffic police, on the specified day, the employees conduct a visual and documentary control of the vehicle.

    When servicing the "Last Call" and "Graduation Party" events, it is required to check the traffic police on the date of service, as well as to inspect the transport by cynologists with a dog for the presence of explosives.

    When transporting children in a column of buses of more than 3 pieces, the customer is obliged to order a traffic police escort car to move ahead of the column, and if the number of buses is more than 10, the traffic police is obliged to provide a car closing the column.

    In accordance with the internal instructions of the Ministry of Education of the Russian Federation regarding excursions in schools, children can be transported, including by public transport, according to the rules in force for this type of transport (metro, tram, trolley bus). It is recommended to use chartered transport.

    To control a group of schoolchildren during the trip, the Customer is obliged to appoint the senior group in the required number. Senior groups receive an introductory briefing on compliance with the rules of children's passenger transportation based on these rules. The speed of the bus when transporting children is limited and should not exceed 60 km/h.

    The rules for transporting children to the place of the school excursion are regulated by the following regulatory documents:

    The organization of a school excursion, which requires the rental of a car, begins with the issuance of the Order of the school principal on the organization of the excursion.

    According to Decree No. 1176 of the Government of the Russian Federation of December 17, 2013, the transportation of an organized group of children can only be carried out on a special bus.

    Today, many companies offer buses for school trips.

    There is no separate license for transporting children .

    According to the legislation, children are classified as passengers, and they are subject to all the rights and obligations of a passenger approved by law.

    Transportation of children on an excursion by road is carried out during daylight hours. Transportation of groups of children at night requires a special permit.

    What group is considered organized?

    According to the law, a group of more than 8 minor children without legal representatives is considered organized. With such a group, there must be an accompanying person on the bus. In the case when more than 20 children are transported in one bus, 2 accompanying persons are allocated.

    If children go on an excursion with their parents, then such a group is considered “unorganized” and the requirements for its transportation are not so strict.

    Organized transportation of minors is allowed only in a situation where the bus is fully equipped with all necessary equipment. When minors under 12 years old are transported, the bus must be equipped with seat belts, restraint devices, and other special means to fix the position of the child.
