How is the penalty imposed?

How is the penalty imposed?

A ban on travel to countries near and far abroad cannot arise due to a delay in paying, for example, a loan for a couple of days. The procedure for generating a fine followed by a ban is as follows:

  • A citizen delays payment on a loan for more than a month. Ignores calls from bank employees, evades debt repayment;
  • The bank sends information about the evasion of repayment of the loan to the court;
  • The court opens the case and then issues a special decision on the recovery of the debt by force;

The presence of the debtor in this case is optional. The judge makes a unilateral decision based on the facts of the case.

  • The decision is sent to the FSSP;
  • The bailiffs notify the debtor of the existence of the debt, handing over the decision. It indicates the amount of the debt, the number of the account to which you want to transfer the amount of money, as well as the need to pay off the debt in a limited period of time - five business days;
  • If the debtor continues to ignore the court order, the bailiffs may withhold part of the salary (take legal action to inquire from work) or seize the debtor's personal belongings.
  • Another punitive measure is the imposition of a ban on traveling abroad (an order is issued as a document confirming the ban). If the debtor does not repay the debt within the allotted time, the corresponding order to ban travel will be sent to the FMS;

It is important

The minimum amount of debt, due to which a court order “with all the consequences” can be issued, is ten thousand rubles.

Purpose of the ban

To force a debtor to pay a debt.

Prohibition for other persons

The ban on traveling abroad may be related to other reasons and depend on the age and type of professional activity. So:

  • If a child who is under the age of eighteen wants to go abroad, then the trip, according to the law, must be approved by both of his parents. They must issue their permission to leave in writing, and then certify it with a notary.

However, there are situations when the parents are divorced and the child plans to go abroad. If one of the parents does not agree that his child will go to some kind of "unknown", then he can submit a written disagreement to leave, and then a ban will be imposed on the child to travel abroad.

  • If military workers want to go abroad, then such an opportunity is presented only to employees on a contract basis. The rest, since last year, have lost this opportunity;
  • Employees who are on public service, do not have the right to travel abroad due to the deterioration of relations between states over the past two years. This is done in order to preserve state secrets and avoid information leakage;

Attention

Travel abroad for employees of the military sphere and government agencies is possible as an exception and strictly by order of superiors.

How to pay a debt?

To pay off the accumulated debt, you can use one of the following methods:

  • Via website federal service bailiffs. In the same section where you can see the presence / absence of a fine, there is a "pay" button, in case there is a fine;
  • Through a bank terminal, using the details of the fine taken on the FSSP website;
  • Using a personal electronic account or online wallet;

Timing

Sometimes money can go to the account up to fourteen days.

  • Having paid the fine, you need to inform the bailiff who informed you about the presence of a debt;

If you yourself found out about the existence of a fine, then the phone number of the required bailiff can be found on the FSSP website, or by calling the information service at the place of residence;

Before planning a trip abroad, you need to make sure that there are / are no fines at least a month before the date of departure. Even after you pay off the money, the bailiff will take time to notify you migration service and customs.

Attention

You should not try to show a check paid for a debt at the airport or at customs. Employees of these organizations are not authorized to accept evidence of the absence of fines in this form.

How can I bypass the travel ban?

If your debt is:

  • Did not have time to "go" to the court order;
  • You did not receive this notice of the bailiff;
  • Debt less than ten thousand rubles;

If none of the above reasons applies to you, then you can cross the border:

  • Accelerating the elimination of the ban on foreign travel. This can be done if the trip abroad is connected with saving the life, health or death of a loved one who lives abroad;
  • Travel abroad through the neighboring countries where there are no customs borders (for example, through Belarus);

Applying the "workaround" method when traveling abroad, in the presence of a ban, may result in the seizure of a foreign document.
