Replacing a passport outside the place of residence

Every resident of the Russian Federation needs to obtain a new passport at least three times after he turns 14, 20 and 45 years old. Marriage, loss or theft of this essential document will also require urgent replacement within the period controlled by applicable law. At the same time, not everyone has the opportunity to go through the replacement procedure at the address of residence on time. Is it possible to change a passport outside the place of registration and what is needed for such a procedure? This is what will be discussed in this article.

Taking into account the law of the Russian Federation, obtaining a Russian passport at a wrong address is legal. The procedure for obtaining is regulated by several acts, including Regulation No. 828 of 07/08/1997, order of the Federal Migration Service of the Russian Federation No. 319, as well as the Administrative Regulations of the Migration Service of the Russian Federation. Based on clause 17 of Order No. 319 and clause 10 of the Regulations, you can submit a package of documentation for replacement to each department of the FMS or MFC located in the Russian Federation. Citizens who do not live at the address of registration are required to issue a document, but in this case, the period for its replacement will be extended.

Why do I need a replacement passport?

There are a number of mandatory reasons, taking into account which each person is obliged to change an invalid passport for a new one. In most situations, employees of the Federal Migration Service or the MFC must issue it after 30 days from the date of submission of the documentation package. If a citizen for some reason does not change it within the time limits established by law, he will have to pay a fine. Without a basic identity card, he will not be able to go to the clinic and other institutions, as well as carry out elementary transactions, for example, in banks, airports and other organizations. The identity card must be changed after:

  • achievement of 20 and 45 years;
  • change of full name, place or date of birth;
  • a radical change in appearance after plastic surgery;
  • floor replacements;
  • loss, damage or theft;
  • detection of errors or inaccurate information.

Replacement after reaching a certain age mark

Every person living in the Russian Federation must change his passport after he turns 20 and 45 years old. This must be done no later than 30 days from the date of birth, so as not to overstay the time frame established by law. Otherwise, you will have to bear administrative responsibility in accordance with Art. 19.15 of the Code of Administrative Offenses and pay a fine in the amount of 2,000 to 5,000 rubles. To prevent this from happening, it is better to personally come to the FMS with an application and a package of documentation, including a photo and a receipt for paying the state duty. Replacement after marriage

Women who marry and take their husband's surname are required to change their identity card, taking into account the norms of the current legislation. Replacing a passport after marriage is a standard procedure and is also carried out within 30 days after marriage registration. In case of violation of the deadlines, you will have to pay a fine of up to 3,000 rubles, its size will be higher for those who live in Moscow and St. Petersburg.

Important! A passport after marriage can be replaced only with the change of surname. According to Art. 32 of the Family Code of the Russian Federation, citizens have the right to keep their surnames or take the premarital surname of one of the spouses.

In addition to the identity card, after the wedding, you will have to replace the main documents if a woman or a man decides to change his last name after marriage. Employees of the FMS or MFC bodies must replace the document within 10 days from the date of application at the place of registration or 30 days after the submission of documentation at the place of residence. This is indicated in clause 27 of the Administrative Regulations, which was established by Order No. 851 of November 13, 2017.

Replacement after theft, damage or loss

An urgent change of an invalid document will be required if it has been lost, stolen or damaged. In case of theft, you need to contact the police with a statement so that the attackers could not use the document. Then you need to apply with a standard package of documentation and a certificate from the police station to the FMS or MFC. Often the passport is lost through the fault of the owner, in this situation it will also require its timely replacement. If the document is damaged, it is important to understand in what cases it will need to be changed, this list includes:

  • marks, inscriptions and drawings not provided for by the rules;
  • mistakes made by employees of the migration service;
  • torn or completely torn pages;
  • wear during operation, including rubbing of inscriptions, stamps and seals;
  • traces of mechanical action, for example, chemicals.

Procedure in other cities and regions

If a person does not live at the registration address, this will not become a problem when changing a document that has become invalid. Taking into account the order of the FMS No. 319 dated November 30, 2012, any person has the right to receive a new document at the address of location. To do this, you must pay a standard state duty in the amount of 500 rubles. It should be borne in mind that employees of the departments of the MFC or the FMS should not refuse the applicant and accept documents for replacement. In case of refusal, you need to contact the prosecutor's office. To replace you need:

  1. Prepare documentation and two photos 3.5 x 4.5.
  2. Pay the prescribed fee.
  3. Send an application to the MFC or FMS.
  4. Get a receipt indicating the date of issue of a new document.
  5. Appear for him at the office at the address of the location.

Every citizen of Russia can obtain a temporary identity card valid for the entire replacement period. A package of documentation can also be submitted using the State Services portal and send all papers in electronic format. The application must be filled out on the website, and the state fee is also paid there. To apply for a new passport, you need to prepare a package of documents, which includes:

  • statement;
  • old passport;
  • two photos;
  • receipt with paid state duty;
  • documents confirming the introduction of new data;

It is also possible to obtain and change an identity card without registering. Most often, such situations arise in people who did not have time to get a residence permit. If a person does not have a registration due to the lack of property in which to register, he will need to pay a fine for violating registration rules. In such a situation, it is advisable to register with a friend, relative, acquaintance who can register a citizen for at least a year, or with the social service authorities at the location.

Important! Often, the FMS refuses to replace if there is no registration at the address of location. Then you need to ask the employees to send a written refusal, which then needs to be sent to the court.

Subject to the law, anyone can receive a new circular without having to register. At the same time, employees refuse to issue it only in those situations if an incomplete package of documentation is provided or it does not meet the stated requirements. A document that does not contain a registration stamp is considered legitimate and legally significant, so its issuance must take place according to the rules.

Is it possible to replace or obtain a passport during temporary registration?

Like permanent, temporary registration allows you to get a new or replace an invalid passport. In such a situation, any person has the right to receive documents without a residence permit and apply to the FMS at the address of their residence. He cannot be held administratively liable, since the registration of a temporary type is quite legitimate and gives grounds for performing all the necessary actions with personal documentation. You need to receive an updated identity card within the time limits regulated by the decree, namely within one month.

When is a house book needed?

In most situations, a citizen does not need to provide an extract from the house book. Most often, it is only necessary to confirm the place of residence if the document has been lost or stolen. Refusal to replace due to not providing a house book is illegal, since paragraph 23 of Order No. 339 of the FMS says that documents can be obtained not at the location. Usually, the house book is asked to provide in order to immediately add the registration address to the passport. But, nevertheless, in other situations, except for loss and theft, a request to present a book is considered illegal.

Reasons why you may be denied a replacement

If you urgently need to replace your passport, and the applicant has provided a complete and correct package of documents, he will be issued a new identity card within a strict time frame in any region of the Russian Federation. But there are cases when employees of the migration service or the MFC refuse to extradite. The reason can be both the banal inattention of the applicant, and more serious problems. A justified refusal is possible in case of lack of citizenship of the Russian Federation, indication of false or lack of necessary data in the application, as well as unpaid state duty. Also, the passport will not be changed if the citizen:

  • did not reach the age limit of 20 or 45 years;
  • incorrectly filled out the application or indicated incorrect data in it;
  • did not provide all the documents;
  • attached a photo that does not meet the requirements;
  • attached to the application documents not in Russian without translation or documentation of foreign countries without an apostille;
  • did not bring an old passport unless it was lost or stolen.

How to change a passport?

Each passport holder is also concerned about the question of whether it is necessary to change it at the address of registration. It should be remembered that FMS employees cannot refuse extradition to any applicant who lives in the territory of the Russian Federation. Such a document is issued even without registration, but it will not be tied to a specific department of the migration service. When submitting a package of documents for obtaining a passport outside the place of registration, the document will be prepared longer than the standard period, which can last up to 4 months.

Is it obligatory to change the passport at the place of residence? Many prefer to receive new documents via the Internet. This can be done using the site - the Unified Portal of State Services and significantly save time. To do this, you must first register on the site and confirm your identity with an electronic signature or card. Replacement using the portal is a standard procedure that does not require much effort and consists of several simple steps. You need to go to the "Public Services" section and select the "Replacement of the Russian Federation Passport" tab, then you need to:

  1. Select the "Get Service" tab.
  2. Specify the reason for the replacement of the identity card.
  3. Fill out the form with personal data.
  4. Indicate the presence or absence of a residence permit in Russia, data on children, marital status and other information.
  5. Enter information about the type of request.
  6. Upload a personal photo.
  7. Re-check all information and submit it for processing.
  8. Wait for feedback to be received by mail and receive a letter in which there should be confirmation of receipt of circulars.
